Reform of the Charter of the French Language

An Act respecting French, the official and common language of Québec (S.Q. 2022, c. 14, hereinafter the Act) was assented to on June 1, 2022 and has been in force since that date, except for several provisions whose coming into force is deferred. It provides for amendments to the Charter of the French Language (R.S.Q., c. C-11, hereinafter "the Charter") and to other laws that apply to municipal bodies.

The purpose of this Act is to affirm that the only official language of Québec is French, the distinctive language that allows the people of Québec, who are predominantly French-speaking, to express their identity. It also affirms that French is the common language of the Quebec nation. 

This law provides a framework for its use by the Administration and creates the duty of exemplarity of the State. In this regard, the Administration must, in an exemplary manner, use the French language, promote its quality, ensure its influence in Quebec and protect it.

  • Publication of positions under section 20.1 of the Charter

    Within three months of the end of its fiscal year, each municipal body shall publish the number of positions within its organization for which it requires knowledge or a specific level of knowledge of a language other than French (s. 20.1). This number includes those for which such knowledge or level of knowledge is either :

    • necessary in order to gain access to it, in particular through recruitment, hiring, transfer or promotion
    • necessary to remain in the company;
    • desirable.

  • Continued recognition of the special linguistic status of Pincourt

    At its regular meeting of January 10, 2023, the Municipal Council of the Town of Pincourt adopted a resolution confirming its intention to maintain the recognition of the special linguistic status of the Town of Pincourt in accordance with section 29.2 of the Charter of the French Language (LRQ, c C-11), within the 120-day time limit imposed.

    On January 19, 2023, the Direction de la francisation de l'Administration et du soutien opérationnel sent the Town of Pincourt a notice of continued recognition of its special linguistic status.

  • Notice of possible withdrawal of recognition of a special language status

    In December 2022, the Office québécois de la langue française sent the Town of Pincourt a notice under section 29. 2 of the Charter, stating that, in light of the linguistic data from each census conducted in accordance with Canadian statistical legislation, the Town of Pincourt did not meet the required threshold (more than half of the residents of its territory having English as their mother tongue) and that, as a result, the recognition of bilingual status obtained by the Town would be withdrawn, by operation of law alone, upon the expiry of a period of 120 days following receipt of this notice.

    This recognition would, however, be maintained if the Town adopted a resolution to this effect before this deadline and notified the Office without delay (which the Town did at its meeting of January 10, 2023, see tab above).
